Standard OEM Parts Warranty Information


The Manufacturer offers a Nationwide 12 month, unlimited mileage warranty OEM (Original Equipment Manufacturer) on most new OEM mechanical components that are purchased by the customer.  As more fully set forth below, wear and tear items, including, but not limited to, tires, brakes and wipers are not covered under this warranty, but may be covered under a warranty offered by the manufacturer of the component.  If a covered OEM component fails and is repaired under the vehicle warranty, the warranty on that component is for the remainder of the OEM vehicle warranty.  Please see your Gengras Dealership service advisor for full details of the OEM Part Warranty and the warranty provided by the manufacturer of a component in component In addition to the OEM Part Warranty, for no additional charge, Gengras provides a Limited Lifetime Warranty on certain mechanical components that are purchased by you, the customer.  See below for full details.

Gengras Limited Lifetime Parts & Labor Warranty

APPLIES ONLY TO REPAIRS PERFORMED BY GENGRAS ON VEHICLES USING OEM PARTS, PAID FOR BY CUSTOMER.  For no additional charge, Gengras provides the following Limited Lifetime Parts and Labor Warranty on the covered OEM parts listed on this repair order.  This Limited Warranty only applies to repairs paid directly by the consumer and does not apply to parts repaired or replaced under any applicable new or used vehicle warranty, manufacturer's warranty, extended warranty, service contract, collision repairs, recall or similar campaign, or repairs performed free of charge or at an associate discount. This Limited Warranty does not apply to vehicles which are used in commercial applications or are not maintained according to manufacturer's recommendations.  Proof of required maintenance must be provided by You upon request.

PARTIES TO THIS LIMITED WARRANTY AND LIMITED WARRANTY PERIOD:  This Limited Warranty is between the owner/lessee of the vehicle at the time the repair is made yourself and Gengras.  This Limited Warranty coverage begins on the original date of service work and ends when the vehicle is no longer owned/leased by you or Gengras is sold or otherwise ceases to exist.  This Limited Warranty may not be transferred.  

LIMITED WARRANTY COVERAGE:  This Limited Warranty is specific to work or repairs performed by Gengras.  All claims and/or repairs associated with this Limited Warranty must be performed at Gengras.  Gengras will not pay for or reimburse you for warranty claims under this Limited Warranty if the replacement of parts and/or labor is performed by any other facility or person.  In the event of a Failure or Mechanical Breakdown of a Covered Part, subject to the terms, conditions, and limitations herein, Gengras will replace the Covered Part(s), including labor; with a new OEM part whenever possible, however, in the event a new OEM part is not available, Gengras reserves the right to: (i) repair the existing defective or broken part, (ii) replace it with our manufactured part or one of like kind and quality, or (iii) refund the cost of the part and installation labor indicated on this repair order.  Parts replaced under this Limited Warranty do not include a Gengras Limited Lifetime warranty, unless otherwise stated in writing by Gengras.  This Limited Warranty becomes null and void if the warranted part is modified, or affected by any other person(s) or facility other than Gengras.  A Failure or Mechanical Breakdown means the failure of a Covered Part due to a manufacturers defect or faulty workmanship, but does not include cosmetic failures or damage.  A Covered Part has failed when it can no longer perform the function for which it was designed.

EXCEPTIONS TO LIMITED WARRANTY:  This Limited Warranty shall not apply nor will Gengras assume responsibility for mechanical breakdown, damage, or Covered Part Failure due to: (i) failure to comply with manufacturer's recommendations, (ii) vehicle tampering or alteration (except as directed by Gengras), (iii) failure of a non-warranted part, or (iv) which the vehicle has been subjected to abuse, commercial use, lack of required maintenance, or accident.  Improper or incorrectly performed maintenance or repair voids this warranty.  You are responsible for any costs not covered by this Limited Warranty.

COVERED PARTS:  Any of the following OEM parts installed on a vehicle by Gengras and listed on this repair order; unless otherwise excluded herein or specifically excluded on the repair order are "Covered Parts" under this Limited

Warranty:
Engine: Engine block, cylinder heads, and all internally lubricated engine parts.  All OEM engine components that are bolted onto or fastened to the engine assembly are covered.

Transmission/Transaxle: Transmission/transaxle case, torque converter, and all internally lubricated parts; shift cover and forks; separate bell housing; transfer case and all internal parts contained within the transfer case; seals and gaskets. (Standard Transmission clutch assemblies and all component parts are not covered.)  Oil pan, TVI/throttle cable, vacuum modulator; transmission mounts.

Drive Axle:  Differential/axle housing(s) and all internally lubricated parts, seals and gaskets.  Constant velocity joints, slip joints, front wheel drive axles/half-shafts and wheel bearings, couplings, flex disc, prop shafts, and center support bearings.

Steering:  Steering gear housing and internal parts, rack and pinion housing and internal parts, power steering pump, seals and gaskets.  Tie rods, idler and pitman arms, center/drag link, coupling and shafts; cooler lines.  Steering wheel tilt and telescoping mechanism.

Brakes:  Brake pads, master cylinder, vacuum or hydraulic brake booster assembly, hydraulic lines, brake hoses and fittings, seals and gaskets, compensator/proportioning valve; metering valve; calipers, piston, seal and dust boot; wheel cylinders, cups, brake adjusters; pedal lever and pedal pivot; parking brake cable, ABS component parts.

Air Conditioning:  Condenser; compressor, evaporator, orifice/expansion valve, seals and gaskets.  Accumulator; receiver drier, automatic temperature control programmer; clutch assembly, control cables, cutoff switch, serpentine belt and tensioner; bearing and pulley.  Mounting brackets, idler pulley and bearings, air conditioning/heater blower motor.

Front and Rear Suspension: Upper and lower control arms, shafts and bushings; struts, ball joints, housing and cartridge, spindle/steering knuckle and spindle support.  Wheel bearings, kingpin and bushings, stabilizer bar, links and bushings, torsion bar, mounts and bushings, track bar, links and bushings.  Coil and leaf springs, shackles, electronic level control components.

Electrical: Batteries (except hybrid and electric vehicle batteries), alternator, voltage regulator; starter, wiper motors, power window motor and switch; window regulators, power seat motor, steering column multi-function switch(s), mirror motor and all electrical switches (except those specifically excluded herein), cooling fan relay; air control solenoid, air regulator valve, I.A.C. motor, all electrical control modules (except those specifically excluded herein), ignition coil, engine distributor; all electrical sensors (except those specifically excluded herein), door lock actuators, rear window defogger (Excluding glass mounted components), horn and relay, all electrical motors (except those specifically excluded herein), switch and solenoid, fuel pulse dampener, fuel pump relay.

Cooling:  Radiator, mounting brackets and coolant recovery tank, fan clutch, fan blades and motor; fan shroud, heater core, transmission cooler, thermostat and housing.

Fuel:  Fuel lines, fuel pressure regulator, level sending unit, fuel injectors and seals, fuel injection control components, throttle body assembly, fuel rail, fuel distributor, trigger contacts, fuel accumulator, tank, tank door latch, tank filler neck and o-ring.

FLUIDS:  Gengras will pay for replacement of necessary fluids, oils, greases, lubricants, gaskets, and seals that must be replaced in conjunction with a covered repair.  

EXCLUDED  PARTS:  All parts not listed as Covered Parts.  Chevrolet Corvette ZRI & Z06, Calloway & Lingenfelter models, Dodge Viper, All Chrysler Group SRT models, BMW 7 Series Alpina model and 760Li sedan.  All after-market parts, remanufactured parts, MOPAR performance parts, turbo charger/supercharger assembly including boost valve and waste gate, body panels, bumpers, moldings, bright metal, glass (including, but not limited to windshield), weather stripping, wind shield wiper blades and inserts, hinges, handles, locks, headlights, taillights, turn signals, lamp assemblies and lenses, interior & exterior trim, carpet, floormats, upholstery, seat covers, door panels, pedals, shift knobs, dash cover & pads, cup holders, ashtrays, light bulbs, fuses, filters, fluids, wheels, tires, brake drums and rotors, standard transmission clutches, universal joints, freeze plugs, hoses, spark plugs, keys, lock cylinders, electronic devices, (including but not limited to: audio systems, alarm systems, Blue Tooth, vehicle control modules, near object avoidance systems, laser radar cruise control components, entertainment systems, any DVD player or component within the DVD system, I-pod system, cameras, parking assist devices, power assist doors, electronic transmitting devices, navigation screen/system, sunroof cables, supplemental restraint systems (including but not limited to air bags and impact/seat sensors) and instrument clusters), hybrid or electric vehicle batteries, vinyl and convertible tops or parts that have failed as a result of corrosion or environmental influence.  Please note that all OEM parts (except batteries) have a standard 12 month manufacturer's limited warranty.

COLLATERAL PARTS: If other non-warranted service repair work, (including but not limited to the replacement of parts damaged by the failure or breakdown of a Covered Part), needs to be performed in order for the warranted part to be properly replaced (e.g. muffler replaced and warranted becomes defective and a replacement muffler will not work properly unless the non-warranted exhaust pipe is replaced) the customer will be required to either (i) agree to such other necessary repair work and pay for it, or (ii) accept the replacement part and have it installed at a service facility of their choice at customer's expense without warranty from Gengras.  Non-warranted parts damaged by the failure of a Covered Part are not covered under this Limited Warranty.

TIRES:  Tires are not covered under this Limited Warranty.  They are covered by the manufacturer's warranty which varies by manufacturer, see manufacture's statement for details.  All tires sold by Gengras are "AS-IS".


HOW TO MAKE A CLAIM; TIME PERIOD FOR WARRANTED WORK TO BE COMPLETED:  In the event of a warranty claim, return your vehicle to the Gengras dealership where the original work was performed with: (i) this original repair order receipt (ii) picture identification, and (iii) copy of current vehicle registration.  If the vehicle can not  be safely operated, please call the Gengras dealership where the original work was performed at and ask for the service department.  Gengras will complete any warranted work hereunder within, a reasonable timeframe, subject to the terms and conditions herein.

OBLIGATIONS OF Gengras: During the term of the Limited Warranty, Gengras' obligation shall be limited to furnishing and installing a replacement part for a failed Covered Part as provided herein, or refunding the cost of the covered part and installation labor in the  amount stated in this repair order.  Gengras shall not be liable for any transportation, towing, accommodation, or any other charges related to or caused by the failure of a Covered Part Repair, replacement, or refund in the manner and for that period of time stipulated hereunder shall constitute the fulfillment of all direct and derivative liability and obligations from Gengras to you.  In no event shall Gengras' liability under this limited Warranty exceed the dollar amount of the original covered part and labor as stated in this repair order:

LIMITATION OF IMPLIED WARRANTIES, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES:  TO THE EXTENT ALLOWED BY LAW, ALL STATUTORY, EXPRESS OR IMPLIED WARRANTIES WITH REGARD TO GENGRAS' REPAIRS, SERVICES, PARTS, OR REPLACEMENT OF COVERED PARTS MADE UNDER THIS LIMITED WARRANTY ARE HEREBY DISCLAIMED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MECHANIC ABILITY AND FITNESS FOR A PARTICULAR PURPOSE (WHETHER OR NOT GENGRAS KNEW OR HAD REASON TO KNOW OF ANY SUCH PURPOSE), AND IN ANY EVENT SHALL NOT EXTEND BEYOND THE DURATION OF THE LIMITED WARRANTY.  TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, YOU WILL NOT BE ENTITLED TO RECOVER FROM GENGRAS ANY PUNITIVE DAMAGES OR CONSEQUENTIAL DAMAGES. DAMAGES TO PROPERTY, DAMAGES FOR LOSS OF TIME, LOSS OF PROFITS OR INCOME, OR ANY OTHER INCIDENTAL DAMAGES EVEN IF GENGRAS HAS BEEN ADVISED, WERE AWARE OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF SAME.  SOME STATES DO NOT ALLOW LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE LIMITATION OF DAMAGES, SO THE LIMITATIONS AND THE EXCLUSIONS IN THIS PARAGRAPH MAY NOT APPLY TO YOU.  Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion my not apply to you.  This Limited Warranty is in lieu of all other express warranties, and Gengras does not authorize any person or representative to assume for Gengras any obligation or liability in connection with repair of a warranted part.  Gengras seeks to comply with all provisions of the Magnusson-Moss Warranty Federal Trade Commission Improvement Act, 15 U.S.C. 2301: if any, which apply.

ARBITRATION:  You agree that all individual, class action, or other claims arising or relating to this Limited Warranty, whether in contract, tort, pursuant to statute, regulation, ordinance, or in equity or otherwise, are subject at YOUR or Gengras' election, to neutral non-binding arbitration by The American Arbitration Association under the applicable AAA rules then in effect as modified by this Arbitration Provision. This includes, but is not limited to, claims asserted by you against Gengras, its affiliates and subsidiaries (including its parent company) and their employees, officers, shareholders, successors, and assigns.  Any arbitration here under shall be governed by the Federal Arbitration Act (9 U.S.C. Section 1 et seq.) and not by any state law concerning arbitration.  The Arbitrator shall follow applicable statutes of limitations, shall honor claims of privilege recognized at law, and, if timely requested by either party, shall provide a brief written explanation of the award's basis.  Each party shall be responsible for its own attorney, expert, or other fees unless applicable law provides otherwise.  Any claim or dispute is to be arbitrated on an individual basis and not as a class action.  You expressly waive any right to arbitrate a class action or in a private attorney general capacity, and there shall be no joinder or consolidation of parties, except for parties to the same contract.  In the event of a conflict between the Arbitration Provision and any other applicable arbitration provision, the other provision's terms shall apply; provided however, that that this Arbitration Provision's prohibition on class wide arbitration shall apply.  If any portion of this Arbitration Provision is deemed invalid or unenforceable, it shall not invalidate the other provisions of this Limited Warranty; provided however, that if the provision prohibiting class wide arbitration is deemed invalid, then this entire Arbitration provision shall be null and void.  This Arbitration Provision shall not apply to any individual claim brought by You in small claims court, unless such claim is transferred, removed, or appealed to a different court.  The decision reached in Arbitration will be binding if so agreed upon by the parties to the arbitration.  This Arbitration Provision shall survive any termination, payoff, or transfer of this Limited Warranty.  Information regarding AAA and its procedures for filing a claim can be found at www.adr.org.  You may file suit under State law prior to utilizing the above dispute resolution procedure; however, you may not be permitted to file suit against Gengras under the Magnusson-Moss Warranty Federal Trade Commission Improvement Act, 15 U.S.C. 2301 until you have tried to resolve any such dispute through the above dispute resolution procedure.


GENERAL TERMS:  The terms and conditions outlined above are the full and complete agreement between the parties concerning the Limited Warranty. No oral representations or statements should be relied upon by You.  If any portion of this Limited Warranty is deemed invalid or unenforceable, it shall not invalidate the other provisions of this Limited Warranty. This Limited Warranty is governed by and interpreted according to the laws of the State of Connecticut, without regard to any principles of conflicts of laws.  No amendment, supplement, or waiver of any provision of this Limited Warranty will be binding against Gengras unless it is in writing.
THE WARRANTIES HEREIN GIVE YOU SPECIFIC LEGAL RIGHTS, HOWEVER, YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

VEHICLE STORAGE CHARGES: Vary by Gengras dealership and are applied, five days from notification of completion of repairs.

CANCELLATION OF REPAIR:  If you cancel the repair work, the vehicle shall be reassembled to a condition reasonably similar as when received, unless customer waives reassembly or the reassembled vehicle would be unsafe, or reassembly is impossible.  Gengras will charge for the cost of disassembly, cost of parts to replace items destroyed by disassembly and the cost to reassemble the vehicle.
